Terms of Service

These Terms of Service ("Terms") govern your use of the website located at lumenphotokyiv.com and your engagement of photography services provided by Lumen Photo LLC ("Lumen Photo", "we", "us", "our"). By accessing this website or booking our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. Acceptance of terms

These Terms constitute a legally binding agreement between you and Lumen Photo LLC. We may update these Terms from time to time. The version in force on the date of your booking or your most recent visit to our website applies. We will post revised Terms on this page with an updated effective date. Continued use of the website after any changes constitutes your acceptance of the revised Terms.

2. Our services

Lumen Photo provides professional photography services including, but not limited to, portrait, personal branding, commercial, product, wedding, editorial, architectural and event photography. We also offer associated services such as professional retouching and printed album design.

The specific scope, deliverables, fees, payment schedule, and timelines for any engagement are set out in a written booking confirmation or proposal provided to you before the session. That booking confirmation prevails over these Terms in the event of any conflict.

3. Bookings and payment

3.1 Booking confirmation

A booking is confirmed when we have received your signed booking confirmation (or written agreement by email) and any applicable deposit. Until that point, a requested date is tentatively held for a maximum of five working days.

3.2 Deposits

Most bookings require a non-refundable deposit of 30–50% of the session fee to secure the date, as specified in your booking confirmation. The remaining balance is due on or before the session day, unless otherwise agreed in writing.

3.3 Invoicing

Invoices are issued in Ukrainian hryvnias (UAH). Payment may be made by bank transfer or other methods agreed at the time of booking. Overdue invoices may incur late payment interest in accordance with applicable Ukrainian law.

4. Cancellation and rescheduling

  • Cancellation more than 72 hours before the session: Any paid balance beyond the non-refundable deposit is refunded in full.
  • Cancellation within 72 hours of the session: A cancellation fee equal to 50% of the total session fee applies. If a deposit has been paid, it is applied against this fee.
  • Rescheduling: Subject to studio availability, we are happy to reschedule at no charge if requested more than 72 hours before the session. Rescheduling requests within 72 hours may be subject to a rescheduling fee as set out in your booking confirmation.
  • Cancellation by Lumen Photo: In the unlikely event we must cancel due to circumstances beyond our control, we will refund all amounts paid and use reasonable efforts to help you find an alternative date or provider.

5. Intellectual property

5.1 Ownership of photographs

All photographs created by Lumen Photo during a session remain the intellectual property of Lumen Photo LLC and are protected by the copyright laws of Ukraine and applicable international conventions. We grant you a licence to use the delivered images in accordance with clause 5.2 below.

5.2 Licence to client

Upon full payment of all fees, we grant you a non-exclusive, non-transferable, royalty-free licence to use the delivered images for the purposes specified in your booking confirmation. Personal-use bookings grant personal, non-commercial use. Commercial-use licences are specified separately and must be agreed before the session.

5.3 Portfolio use

Unless you have expressly instructed us in writing that images are confidential or may not be published, we reserve the right to use a selection of photographs from any session in our portfolio, website and marketing materials. We will always respect reasonable confidentiality requests made before the session.

5.4 Website content

All other content on this website — text, layout, graphics and design — is the property of Lumen Photo or its licensors and may not be reproduced without prior written consent.

6. Use of the website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of it. You must not:

  • Submit false, misleading or unlawful information through our contact form.
  • Attempt to gain unauthorised access to any part of our website or systems.
  • Transmit any malware, spam or other harmful code.
  • Harvest or collect information about other users without consent.
  • Use the site in any way that could damage, disable or overburden our infrastructure.

7. Disclaimers

The website and its content are provided "as is" for general information purposes. While we take care to keep information accurate and current, we make no warranty that the website will be uninterrupted, error-free or free of viruses. Information on this website does not constitute professional advice for your specific circumstances. Professional services are delivered only under a signed booking confirmation.

8. Limitation of liability

To the maximum extent permitted by the laws of Ukraine, Lumen Photo's total liability to you for any claim arising from these Terms or your use of our website shall not exceed the total fees paid by you for the specific session to which the claim relates. We shall not be liable for any indirect, incidental, special or consequential loss or damage, including loss of revenue, loss of data or loss of opportunity.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot lawfully be excluded.

9. Third-party services and links

Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices or terms of any third-party sites. Links do not constitute an endorsement.

10. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of Ukraine. Any dispute arising from these Terms or your use of our website or services shall be subject to the exclusive jurisdiction of the competent courts of Ukraine, unless the parties agree in writing to an alternative dispute resolution mechanism.

11. Changes to these terms

We reserve the right to modify these Terms at any time. The current version is always available on this page. Bookings placed before a change in Terms remain governed by the Terms in force at the time of booking, unless both parties agree otherwise in writing.
